Nita Mastin sued her former husband, John Mastin, for breach of their contractual alimony agreement. All issues relating to the alimony arrearage were determined in Nitas favor through partial summary judgment. The issues of acceleration of future payments and attorneys fees were resolved in Nitas favor after a bench trial. Because we conclude that Nita did not give clear notice of an intent to accelerate future payments, we reverse in part.
